That actually impresses me a little -- since I think it still only takes two Supremes to decide to hear a case, that means that even Scalia and his butt-buddy didn't go for this one.

Never mind -- looks like it was Kennedy who decided not to hear it, as emergencies just go to one justice, it seems.

Actually he did pass the decision onto the full court.. and they decided, for the fifth time, not to get involved.
